By using this Site or any of Our services you agree to comply with and be legally bound by these Terms.

 

Scope of Service

The Good Index provides an online platform to aid decision making on the right retreat for you. The content on the website is correct to the best of The Good Index’s knowledge at the time of publishing, however the Retreat’s own website should be checked prior to booking to ensure information is correct. Whilst all efforts are made to ensure that information remains correct, we cannot be held responsible for any errors or omissions. All opinions expressed on The Good Index via reviews or blog posts are those of the The Good Index team or external reviewers and do not reflect the views of the Retreat itself.

 

Bookings

The Good Index is not a booking platform and all responsibility for bookings sits with the Operator of the accommodation and/or services that you choose. All Bookings are subject to the Operators’ terms and conditions, which should be read in conjunction with these Terms. Our role is limited to provision of information to allow the customer to compare retreats.

 

Customer Obligations

You understand that the advice provided by The Good Index is general in nature and that any clarifications, special requests or requirements that are important for your Booking should be confirmed directly with the Operator. You are solely responsible for deciding whether a destination, accommodation or associated service is suitable for your needs.

 

Pricing & Fees

Average Rates Per Night provided in all search results and at the top of each accommodation listing are exclusive of any fees and provided as a guideline only. Rates for your travel dates may be higher or lower than those quoted. These rates are provided in the currency of the Operator. Rates are exclusive of fees, but inclusive of GST and all other taxes unless specified otherwise.

 

Feedback & Complaints

Feedback and complaints relating to our Site or services should be directed to hello@thegoodindex.com . Feedback and complaints relating to accommodation and associated services should be addressed immediately with the Operator. Where necessary, a follow up written complaint should be sent directly to the Operator within 7 days. In the event of any grievance or complaint leading to a dispute between you and the Operator, The Good Index will not act on behalf of you or the Operator.

Images & text throughout the Site are copyright protected. Images are used with permission and may not be reproduced, copied, transmitted, or manipulated without the written permission of the respective copyright holders. Copyright belongs to the individual Retreat Operators or are sourced from Unsplash.

The Site may contain links to third party websites or resources. We do not endorse and nor are we responsible or liable for the reliability, availability or accuracy of such websites. Some parts of the Site use additional third-party services such as Google Maps. Your use of these services is subject to the respective terms and conditions of each service.

 

Changes to these Terms

These terms may be updated or changed at any time without prior notice. Changes will be posted on our Site. By continuing to use the Site you are indicating that you agree to be bound by the modified Terms.

 

Liability

Without exclusion or limitation of your statutory consumer rights, we will not be liable for any losses, damages, liability, claim or expense (howsoever caused, including negligence, and whether direct, indirect or consequential) arising from the use of or connected with our Site or any accommodation or services Booked via our Site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our Site or any linked site. We exclude all conditions and warranties relating to the site and the associated third party booking engine. In particular, we do not make any representations or warranties that the site will be uninterrupted or error free. Where our liability cannot be excluded, to the extent permitted by law such liability is limited to the value of the Booking made. You acknowledge that you will be liable for any illegal, improper, inappropriate or defamatory material which you may post to the Site and you will indemnify The Good Index and it’s Operators from any claim, demand or loss arising out of your breach of this agreement, your violation of the law or the rights of a third party, or your use of this Site.

Provisions

If any provision of this Agreement is or becomes invalid or non- binding, the Parties shall remain bound by all other provisions.

 

Governing Law

This agreement will be governed, construed, and enforced in accordance with the laws of New South Wales, Australia.

“Operator” means the owner or manager of the accommodation or experience

“Booking” is when you have received confirmation of your booking request from the Operator

We are committed to protecting the privacy of our users. To ensure the protection of personal data, we adhere to the Australian Privacy Act 1988 (Commonwealth) and the National Privacy Principles.

Personal Information

The type of personal information we collect from you depends on the interaction that you have with our Site. For example, to register for our updates we may ask for your name and email address.

It allows us to remember you and enhance your experience with the Site. You can set your browser to refuse cookies however you may not be able to enjoy all of the facilities or book on our site if you do so.

We only disclose your personal information to Operators for the purposes of arranging the services you have enquired about. Please note that in some cases the Operator may be based in a country that may have different privacy laws to Australia.

 

We will use your email address and phone number to contact you from time to time with information about updates, offers and new services. You may update your subscription preferences at any time. Booking correspondence will be between you and the Operator, however we may at times contact you about your booking request if relevant.

 

We may also disclose your personal information as required by law. This may include law enforcement officials investigating fraud or suspected unlawful activity, or Government officials in the case of an accident, disaster or emergency.

 

We use your non-personal information to tailor your experience on the Site and deliver the best information and services to you. We collect information relating to customer trends and patterns and use cookies and software tools to measure site usage and related information.

Protecting your information and keeping it accurate.

 

The security of your information is important to us and we take all reasonable steps necessary to protect it. Personally identifiable information is stored on secured servers that are not publicly accessible and are located in secure facilities . This information is only accessible by The Good Index employees and contractors. Credit card details supplied by you are not stored on our databases.

While we strive to protect the personal information and privacy of users of the Site, we cannot guarantee the security of any information that you disclose online and you disclose that information at your own risk.
